Living Will
A Living Will (sometimes know as a Directive to Physician) is the document that declares that if at any time the person who creates the Living Will should have an incurable, irreversible injury, decease or illness that is determined by their attending physician to be a terminal condition where death is imminent (in other words, they will die very shortly), they do not want death delaying procedures used that would only prolong the dying process but allow him or her to die naturally with only the administration of medication, sustenance, or the performance of any medical procedure deemed necessary by the attending physician to provide them with comfort care.
Last Will & Testament
A Last Will and Testament is a legal document that allows a person to express their wishes as to who will receive their assets after their death. One or more persons called “executors” can be appointed who have the power to settle the estate. The executors can be appointed as Co-executors or in successive order. A Last Will and Testament only controls assets titled in that person’s name alone (not jointly held assets or accounts with beneficiary designations). Most importantly, a Last Will and Testament does NOT avoid Probate. Typically, they are the GATEWAY to Probate.
Pour-Over Wills
A pour-over will is a special type of last will and testament used in conjunction with a trust based estate plan. It typically passes on only personal property such as jewelry, clothing, furniture, etc. It directs that all titled property (real estate, bank accounts, investment accounts, etc.) be disposed of via the Revocable Living Trust. It can save the day when the Settlor of the Trust neglects to transfer all his or her titled property into the trust over the years. The pour-over will ensures that the omitted property will be added to the trust at the Settlor’s death. However, a pour-over will should only act as a safety net for omitted assets as those assets will have to go through Probate before being transferred into the Trust. This is why “funding” the Revocable Living Trust is so important.

His assistants even sat with us to call all our financial sources to make sure our assets were properly titled for the trust. I had just moved to Westmont and attended a Seminar hosted by Attorney David Boone to revisit my Retirement Plans; this was 10 years ago and I have been completely satisfied since. We met Mr. Boone during a public seminar on retirement and were impressed with the thoroughness of his presentation, as well as his sincerity in wanting to assist others with their retirement plans. We decided to follow up and utilize his office to set up our wills, trust and estate plans. We were both very pleased with the amount of attention to detail that they provided, the down to earth manner in which technicalities were explained, and the well organized final product we received. Best of all was the price we were charged…about half of what we had expected going into the process (after some preliminary research). With wills and trust, I guess the good news is that we haven’t had to use it yet! However, we’re very confident that when the time comes, our next of kin will have a much easier time navigating everything, with minimal legal hassles, than I did when my dad passed. We’d highly recommend David and his team to anyone considering such services…having a plan really does give good peace of mind and we felt confident that David understood us and ensured that we developed a plan that will meet our needs in the years ahead.

His presentation was very informative and ended with him saying that his firm offers a free consultation. Years later when I finally needed help with my estate planning, I had contacted several estate planning lawyers who were recommended to me, but found that they charged very high consultation fees. Remembering David Boone, I contacted his office for an appointment not certain of the quality of his free consultation. My Trustee and I were amazed at being greeted by several of David Boone’s professional associates and led into a large conference room. David himself was not able to attend, but made himself available through video conferencing on a large TV screen.Our consultation lasted nearly two hours in which we were given detailed advice on how to proceed as well as other valuable information. David Boone did a horrible job with my mother’s estate. Not only did he not protect Mom’s wishes he made it possible for beneficiaries to be changed, joint owners to be added to bank accounts and executor to be ignored.
